All memberships last for 12 months from the join date. To resign from the toy library, you must provide one months’ written notice. If a member cancels their membership within one month of joinging, their fee will be refunded minus a $10 administration fee (cancellation subject to toy library's usual rules and procedures). Members who do not renew their membership within a month of it expiring are suspended.
Members pay a one-off $20 bond in addition to their membership fee. The bond is refunded upon resignation, provided all conditions of membership are met. This includes attending at least one roster shift per school term, returning all the toys in acceptable condition and having no late or other fees pending. The resigning member needs to submit a written request to hello@diamondvalleytoylibrary.org.au for the bond refund. The bond is refunded by electronic transfer.
A reduced membership rate is available for Roster Shift Co-ordinators (RSCs) for taking on the additional role and increased roster shift frequency. This type of membership is available once RSC training is complete. If you wish to become an RSC, please contact us on hello@diamondvalleytoylibrary.org.au.
TOY BORROWING
Each member is able to borrow up to five toys at a time. The borrowing period is three weeks. As the school holidays approach, the borrowing period is extended to 4 weeks (because the DVTL is closed over the school holidays).
You have a full week from the toys’ due date to return them. For toys returned after the one-week grace period, the late fine is $1 per toy per week. If circumstances (illness, holiday) mean you cannot return the toys in that time, please contact us and we will adjust the due date.
Before borrowing the toy, please make sure the contents of the box/bag matches the toy label. If a piece is missing, please tell the volunteers on duty before taking the toy out of the library. Otherwise, you may be liable for lost pieces.
If you misplace a toy piece, you may re-borrow the toy for another three weeks to look for the missing piece, or you may pay a $2 fine per each missing piece, which will be refunded when the pieces are returned.
If a toy is broken, please let us know straight away, so we can remove it from borrowing for maintenance. If the toy cannot be repaired, we may ask you to pay a small fee to cover the cost of its replacement. This is very rare, and the amount would take into account the age, popularity and previous condition of the toy.
Please clean the toys before returning them if they need it.
ROSTER SHIFTS
The DVTL is a member-run volunteer organisation and all members complete at least one roster shift session per school term.
Roster shifts are a great way to meet some fellow parents in the area and check out the toys on offer. Plus, you’ll have the first pick of toys to borrow! Children are very welcome to come with you – there are plenty of toys to amuse them.
Each session is run by two or three people. The Roster Shift Co-ordinator (RSC) has had additional training and takes care of any issues that may arise such as missing pieces, inquiries, etc. The RSC records borrowings and returns in the computer system. Members help set up the room, check and put away toys being returned and help tidy the room at the end of the session.
Members are able to nominate their preferred shift each term through the online roster. If you don't select a roster shift, one will be allocated for you by the Roster Manager based on the preferred days you indicated on your membership form.
On the day of your roster shift, please arrive 10 minutes prior to the start of the session to help with setup and plan on remaining for 10 minutes after the session to help pack up.
If you can’t make it to your scheduled roster shift, please do your best to find a replacement. This can be a family member or friend, or you could swap with another member (names and phone numbers are on the membership roster). You should notify us of the swap at hello@diamondvalleytoylibrary.org.au.
If you miss your roster shift, you will need to make it up. Roster shifts are a condition of membership. Members who consistently miss roster shifts are deemed to be violating the conditions of membership and may have their membership cancelled. They may also lose their bond.
The Diamond Valley Toy Library ("Provider") is pleased to make bicycles and scooters available to subscribers ("the Service").
As a subscriber to the Service you acknowledge that there are dangers and risks inherent with bicycle and scooter riding (the “Activity”) to which any child under your supervision ("Your Child") may be exposed.
The Provider does not provide protective clothing or bicycle helmets and it is your responsibility to ensure that Your Child wears a helmet at all times and is otherwise appropriately attired when participating in the Activity.
You agree that Your Child will participate in the Activity at your own risk. You also agree to voluntarily assume responsibility for supervising the Activity and any injury, death or property damage you or Your Child may suffer or cause as a result of participating in the Activity.
To the maximum extent possible at law, you (both in your personal capacity and on behalf of Your Child) agree to release, hold harmless and indemnify the Provider and its respective officers, employees, servants, agents and contractors (the “Indemnified Persons”) against all actions, claims, suits, costs, expenses, demands and damages suffered or incurred by the Indemnified Persons or any one or more of them by reason of, or in respect of, or in any manner whatsoever arising out of, or caused by, your use of the Service or Your Child's participation in the Activity.
You agree that you are subscribing to the Service on the express condition that the Provider:(a) will, under no circumstances be liable or responsible in any manner whatsoever for any death, loss, accident, damage or injury to you, Your Child or any of your servants, agents, contractors, visitors or invitees or any other person whatsoever (“Related Party”) which may happen as a result of your use of the Service or Your Child participating in the Activity; and(b) will not incur or be under any liability whatsoever to you, Your Child, or to any Related Party for any loss, damage or injury to or in respect of any of your property or of any Related Party’s property.
The Provider is not liable to you, Your Child or any Related Party in respect of any indirect or consequential loss. For the avoidance of doubt, ‘consequential loss’ means loss or damage arising from a breach of contract, tort (including negligence), under statute or any other basis in law or equity of an indirect or consequential nature including, but without limitation, loss of profits, loss of revenue, loss or denial of opportunity, loss of goodwill, loss of business reputation, future reputation or publicity, damage to credit rating and indirect, remote, abnormal or unforeseeable loss, or any similar loss whether or not in the reasonable contemplation of the parties.
